1. Agreement to Terms

By accessing or using IFS Voice ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

IFS Voice is operated by Aiden Buis ("we," "our," or "us"), located at Gansstraat 170, 3582 EP Utrecht, The Netherlands.

2. Eligibility

You must be at least 16 years old to use IFS Voice. By using the App, you represent and warrant that you meet this age requirement.

The App has been rated 16+ on the App Store due to its therapeutic content and medical/treatment information. We recommend adult supervision for users under 18.

The App is intended for personal, non-commercial use only.

3. Description of Service

IFS Voice provides voice-guided Internal Family Systems (IFS) practice sessions powered by artificial intelligence. The App is designed to support your IFS practice between therapy sessions.

4. Subscription and Payment Terms

4.1 Free Trial

New users receive a free trial with full access to the App:

• Monthly subscription: 7-day free trial
• Annual subscription: 14-day free trial

After the trial period, you must subscribe to continue using the App. You can cancel anytime during the trial without being charged.

4.2 Subscription Plans

IFS Voice offers the following subscription options:

• Monthly: $14.99 USD per month, billed monthly
• Annual: $79.99 USD per year, billed annually (equivalent to $6.67/month)

Prices may vary by region and are subject to applicable taxes.

4.3 Subscription Features

Active subscribers receive:

• 90 minutes of voice session time per day (resets daily)
• 2 Deep Dive tokens per month (each adds 90 additional minutes to a single day's usage)
• Unlimited sessions within daily time limits
• Access to all IFS session types
• Encrypted local storage of session history

4.4 Usage Limits

To promote healthy usage patterns and manage costs:

• Daily base limit is 90 minutes (resets at midnight in your timezone)
• Deep Dive tokens add 90 minutes each to a single day (maximum 270 minutes per day)
• Deep Dive tokens refresh monthly with your subscription renewal
• Unused minutes and tokens do not roll over

4.5 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before renewal. You will be charged through your App Store or Google Play account.

4.6 Cancellation and Refunds

You can cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period—you will retain access until then.

Refund Policy: Refunds are handled according to Apple's App Store and Google Play Store policies. Generally, purchases are non-refundable, but you may request a refund directly through Apple or Google within their respective refund windows.

4.7 Price Changes

We reserve the right to change subscription prices with at least 30 days' notice. Price changes will not affect your current subscription period but will apply upon renewal.

5. Acceptable Use

You agree to use IFS Voice only for its intended purpose and in compliance with all applicable laws. You will NOT:

• Use the App in any way that violates local, state, national, or international law
• Attempt to reverse engineer, decompile, or disassemble the App
• Use the App to harm, threaten, or harass others
• Interfere with or disrupt the App's servers or networks
• Attempt to gain unauthorized access to any part of the App
• Use automated systems (bots, scripts) to access the App
• Share your account or subscription with others
• Use the App for any commercial purpose without our written permission

6. Intellectual Property Rights

The App, including its design, features, functionality, code, content, and AI models, is owned by Aiden Buis and protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of any content you create through your use of the App (session transcripts, notes, etc.), which is stored locally on your device. We claim no ownership over your personal session content.

License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal use in accordance with these Terms.

7. Privacy and Data Security

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

Key points:

• Your conversation content is stored encrypted on your device only
• We collect minimal anonymous usage data (duration, session counts)
• Audio is processed in real-time and immediately deleted
• You can delete your account and all associated data at any time

8. Disclaimers and Limitations of Liability

8.1 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The results from using the App will be accurate or reliable
• The quality of the AI-generated content will meet your expectations
• Any errors in the App will be corrected

8.2 Medical Disclaimer

IFS Voice is not a medical device and does not provide medical advice, diagnosis, or treatment. The AI-generated guidance is for informational and self-help purposes only and should not replace professional mental health care.

Always seek the advice of a qualified healthcare provider with any questions regarding a medical or mental health condition. Never disregard professional medical advice or delay seeking it because of something you experienced through the App.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AIDEN BUIS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or other harmful code transmitted through the App
• Any errors, omissions, or inaccuracies in AI-generated content
• Any harm resulting from following AI-generated guidance

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

8.4 Third-Party Services

The App relies on third-party AI services (DeepInfra) and payment processors (RevenueCat, App Store/Play Store). We are not responsible for any failures, errors, or issues arising from these third-party services.

9. Indemnification

You agree to indemnify, defend, and hold harmless Aiden Buis from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any harm caused by your reliance on AI-generated content

10. Termination

We may suspend or terminate your access to the App immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Suspected fraudulent or abusive behavior
• Non-payment of subscription fees
• Request from law enforcement or government authorities

You may terminate your account at any time by:

• Canceling your subscription through the App Store or Google Play
• Using the "Delete Account" feature in the App settings
• Contacting us at hello@aidenbuis.com

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Updating the "Last Updated" date at the top of these Terms
• Displaying an in-app notification
• Sending a notice through the App or to your contact information (if provided)

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the App.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Netherlands, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Informal Negotiation: Contact us at hello@aidenbuis.com to attempt to resolve the dispute informally
2. Mediation: If informal negotiation fails, we agree to attempt mediation before pursuing legal action
3. Jurisdiction: If legal action is necessary, the courts of Utrecht, The Netherlands shall have exclusive jurisdiction

Nothing in these Terms affects your statutory rights as a consumer.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aiden Buis regarding the use of IFS Voice and supersede any prior agreements.

BY USING IFS VOICE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. YOU ALSO ACKNOWLEDGE THAT THE APP IS NOT A SUBSTITUTE FOR PROFESSIONAL THERAPY AND SHOULD NOT BE USED IN CRISIS SITUATIONS.
